Travel contract enables hospice patient to visit family

Ann Fischetti enjoyed a trip to California to see visit her family.

Ann Fischetti knows firsthand how fragile life can be. Just six months ago, the 81-year-old Eau Claire, Wisconsin, woman was feeling fine and eagerly awaiting the holidays. Now, Fischetti's health has taken a turn for the worse, and her prognosis is not good.

But she's determined to make the most of every remaining moment she has. Her recent trip to California is evidence of that.

Fischetti, a mother of five, grandmother and, now, great grandmother, discovered a large lump in her chest on Dec. 20, 2013. With relatives due to arrive any day and not wanting to worry anyone during their family doings, she waited until after the holidays to act on her revelation.

Her doctor ordered a mammogram and ultrasounds and, through those tests, Fischetti learned that she had advanced stage four lung cancer and a cancerous lump in her chest.

Despite undergoing radiation therapy, the tumor in her chest continued to grow, and she entered Mayo Clinic Health System's Home Health & Hospice program in February.

Fischetti, who had an estimated six-month life expectancy, deeply wanted to visit family in California while she still felt well enough and, with the help of her daughter and hospice team, planned an unforgettable nine-day trip there.

"I wanted to say goodbye to my brother and his family, and I wanted to spend more time with my son," she says.

Since cross-country travel isn't typical for hospice patients, those who've pursued similar endeavors have generally been discharged from hospice care until they returned to the area. Fischetti's request prompted a different course of action — a traveling contract.

"What appealed to her about hospice, in general, was to have someone to call if something would change and to avoid having to rush to the emergency room," explains Billie Anderson, the social worker who helped facilitate Fischetti's traveling contract arrangements. "This led to looking to see if we could help meet her goal of going on the trip and her goal also of having hospice there and potentially having us to co-manage her care from a distance."

Home Health & Hospice worked quickly to identify a receiving hospice agency willing to support Fischetti, including after-hours care, if needed.

"It was such a comfort to know that if anything happened to me while I was out there, I did have hospice to lean on, and they were there for me. It gave me a feeling of security in case anything happened. It was just like somebody there to catch you if you stumbled," Fischetti says.

She never needed care from the other hospice agency but appreciated the safety net the arrangement provided her.

Kelly Sikkink, assistant administrator of Home Health & Hospice, applauds Fischetti for entering the hospice program early enough to take advantage of options like this and demonstrating how patients can live life to the fullest. She notes that her request has expedited the development of a traveling contract template for all affiliate Mayo hospice programs to use going forward.

"We're hoping her story inspires other people to elect hospice care earlier so they can make the most of what time remains" Sikkink says.

Likewise, Fischetti has nothing but praise for the Mayo Clinic Health System hospice team.

"I can't praise them enough," she says. "They have just been awesome."

ENTIRE SET OF 6 CONTRACTS

Compliant contracts are an essential component of the Office of Inspector General's (OIG) recommendations for an effective compliance program. The hospice experts at Weatherbee Resources and Arent Fox, LLP , a healthcare law firm, have created 6 Hospice Form Contract templates that allow the hospice provider and/or its legal counsel to customize each contract to include any state, federal, accreditation, or best practice language.

Click here to read disclaimer information and see an abbreviated sample contract (non-editable / non-printable)..

The Business Associate Agreement (BAA) is a legal document between a healthcare provider and a contractor/vendor (e.g., pharmacy provider, medical equipment supplier, etc.) intended to communicate the parties' obligation to safeguard Protected Health Information (PHI). This legal contract satisfies Health Insurance Portability and Accountability Act of 1996 (HIPAA) regulations when the contractor/vendor has access to a hospice's PHI. This contract creates a bond of liability between the parties who create, transmit, or receive information and/or documentation that contains PHI.

General Inpatient Care Contract

General Inpatient (GIP) care and services are available to hospice patients for short-term acute or chronic pain management or other symptom crisis, provided in an inpatient facility when a patient's care cannot be managed in an alternate setting. The Centers for Medicare and Medicaid Services (CMS) has long expressed concerns about possible misuse of GIP such as: care being billed for but not provided, long lengths of stay, and beneficiaries receiving care unnecessarily. Therefore, it is vital that General Inpatient Care contracts are written in a manner compliant with state and federal regulations and contain each parties' individual and collective responsibilities related to patient care in order to avoid the risk of noncompliant practices and negative payment implications.

Inpatient Respite Care Contract

CMS defines respite care as, "... short-term inpatient care provided to the individual only when necessary to relieve the family members or the person caring for the individual at home." Weatherbee's Inpatient Respite Care contract aligns the hospice's Respite Care policies with Respite facility's procedures to ensure both parties meet the Respite needs of the patient/family, while ensuring mutual adherence to the patient's palliative Plan of Care established by the hospice.

Skilled Nursing Facility / Nursing Facility Resident Contract

A Skilled Nursing Facility (SNF) or Nursing Facility (NF) provides medically necessary professional services from nurses, physical and occupational therapists, speech pathologists, and audiologists to hospice patients, based on the needs identified in the patient's Plan of Care. Skilled nursing facilities provide round-the-clock assistance with patients' care needs and activities of daily living. There are numerous federal regulations and OIG recommendations regarding what hospices, SNFs, and NFs must do to demonstrate compliance and receive payment from Medicare and/or Medicaid programs. Weatherbee's SNF/NF contract includes the parties' individual and collective responsibilities related to patient care while ensuring compliance with state and federal regulations.

Medical Director and Hospice Physician Contracts   (2 separate contracts)

The Hospice Medical Director and Physician member(s) of the interdisciplinary group (Hospice Physician), in conjunction with the patient's attending physician, are responsible for the palliation and management of the needs of the hospice patient. Weatherbee's contracts for the Medical Director and Hospice Physician outline the administrative and patient care responsibilities of the physician as well as other compliance-specific elements designed to promote the highest quality of patient care.

When purchased individually or as a full set, each contract is an electronic, downloadable product. An email will be sent to the purchaser with instructions for downloading and accessing the contract(s). The contracts are drafted in Microsoft® Office Word format, which can be edited and/or customized to meet the unique needs of a hospice provider.

Hcn members receive a 10% discount only if the six (6) contracts are purchased as a set. call (866) 969-7124 to verify hcn membership and order., purchasers of this hospice form contract are permitted to use the contractual language contained herein for one location only; pricing is available for hospices with multiple locations. no part of this contract may be reproduced in any form or by any means, electronic of mechanical including photocopying, recording or by and information storage and retrieval system and shared with third parties, without prior written permission fo weatherbee resources and arent fox, llp. to license the hospice form contract template(s) for use at more than one location, please contact weatherbee resources at (866) 969-7124 or email [email protected].

What to Know About Hospice Travel Nurse Assignments

  • December 20, 2022

Hospice travel nurses provide end-of-life care for patients not currently undergoing treatment for an illness. The job of a hospice travel nurse is to provide comfort and care for patients who have been given a short period of time left to live. Because patients are not actively undergoing treatment, hospice nurses help patients manage pain and symptoms while also providing support for the patient’s family.

Here’s everything you need to know about hospice travel nurse assignments and travel nurse contracts .

What does a hospice travel nurse assignment entail?

Because hospice travel nurse assignments are specifically about providing end-of-life or palliative care for patients, a hospice travel nurse’s main responsibility is to ensure patient comfort. Responsibilities will include taking vitals, engaging with the patient to see how they are feeling, and monitoring the patient’s eating and sleeping.

Hospice nurses may also manage a patient’s medication, determine which medical supplies are needed for patient care, and coordinate with the patient’s doctors. In addition to those medical components of the job, hospice nurses also act as the emotional support system for both the patient and the family, connecting them to necessary care, resources, and information.

Where do hospice travel nurses work?

Hospice travel nurses can work in various settings, making this type of work a unique travel nurse assignment. Hospice travel nurses may work in their patients’ homes, in a specialized care facility, a nursing home, a long-term care facility, or a hospital. It depends on the patient’s level of care needed and the type of assignment.

How is a hospice travel nurse assignment different from other travel nurse assignments?

A hospice travel nurse assignment differs from other travel nurse assignments because hospice nurses do not treat an illness as they would in a hospital. Instead, they provide ongoing care to ensure a patient’s overall comfort. It’s an essential role to be played, and it requires delicacy, compassion, and an understanding of the fullness of the patient’s needs.

How long are hospice travel nurse assignments?

Hospice travel nurse assignments vary in length, just like any other travel nurse assignment. While the most common length of assignment for a travel nurse is about 13 or 14 weeks, this depends greatly on the location and type of work you will be completing.

If you’re looking for a hospice travel nurse assignment, check our job board (and specify a “hospice” specialty) for the latest travel nurse jobs in the top travel nurse locations !

How much do hospice travel nurse assignments pay?

Hospice travel nurse assignments can offer competitive pay, especially depending on the location and the organization. Your pay will largely depend on your contract, where you plan to work, and the length of the assignment.

Here’s everything that goes into a travel nurse salary pay scale and how to understand your pay package .

What are the benefits and challenges of a hospice travel nurse assignment?

Because hospice nursing jobs require the nurse to be hands-on and involved in every aspect of patient care, a hospice travel nurse assignment is a great opportunity to develop your skills and become a more seasoned nurse. Hospice travel nurses have more autonomy because they don’t work inside of a hospital—and some nurses may prefer this type of work environment.

On the flip side, hospice travel nursing can be challenging because of the emotional toll it can take on providers. The work is very emotionally demanding, and working from a patient’s home can be difficult, especially if the patient’s home environment is unstable or family members are difficult.

How can I find a hospice travel nurse assignment?

If you think a hospice travel nurse assignment is a good fit for you and is aligned with your goals, then we’ve got you covered. Visit our job board to find active and available hospice travel nurse assignments (just specify “hospice” as a filter for the list). At Nurse First, we’re committed to providing the best job offerings with all the information you need to succeed in your assignment.

10. Communication

2. Communication Protocol. Prior to the admission of any Resident to Hospice, Hospice and Facility shall work together to develop a written communication protocol governing how they will communicate all information needed for the Resident’s care (such as physician orders and medication information), including how such communication will be documented to ensure that the needs of Residents are addressed and met 24 hours a day. The communication protocol shall include, among other things, a procedure that clearly outlines the chain of communication between the parties in the event a crisis or emergency develops, a change of condition occurs, and/or changes to the Hospice plan of care are indicated, and it must also address how hospice physician orders will be communicated to Facility staff. Such protocol shall be distributed to all Hospice and Facility staff involved in the Resident’s care.

3. Care Planning. Hospice and Facility shall permit each other to attend care planning meetings involving any Resident under Hospice’s care. Each party may reasonably request that a care planning meeting be held with the other to the extent such party has identified specific concerns involving the care of a Resident under Hospice’s care.

Billing/Reimbursement for Services

1. General. Each party shall bill the appropriate payer, and/or the Resident as appropriate, for covered and non-covered items and services rendered by such party to any Resident under Hospice’s care, in accordance with applicable law (with the exception of any portion of the room and board provided by Facility that is covered by Medicaid, which shall be billed to Medicaid by Hospice, and reimbursement for such room and board shall be passed through to Facility, subject to state law). Any hospice items or services that are to be provided to a Resident under Hospice’s care by the Facility under arrangement with Hospice shall be governed by a separate written agreement, which may be in the form of an addendum to this Agreement, that requires all compensation for such items or services to be consistent with fair market value.

2. Billing/Payment Procedures. Facility shall bill Hospice on a monthly basis for each month during the Initial Term and any applicable Renewal Terms for any amounts due to Facility from Hospice. Facility shall provide Hospice with an invoice for the amounts due by the last day of the month immediately following the month in which the Facility provided the items or services. Such invoice shall include information sufficient for Hospice to verify the services. Hospice shall pay Facility for services provided by Facility under this Agreement within (thirty (30)) days for such services. In the event this Agreement is terminated, Hospice shall pay for all services provided by Facility to Residents who are under Hospice’s care prior to the termination date.

No Payments for Referrals

Payments by Hospice to Facility for room and board shall not exceed the amount Facility otherwise would have received had the Resident not been under Hospice’s care. Hospice shall make no additional payments to the Facility for services that are generally considered included in the payer’s room and board payment to Hospice.

Except for any purchased items or services as otherwise governed by a separate written agreement pursuant to Sections 1(f) and 4(a), this Agreement covers all of the items and services to be provided by Facility to Hospice and all payments to be made by Hospice to Facility therefore.

Term and Termination

1. The term of this Agreement shall commence as of the Effective Date and shall continue in effect, unless sooner terminated as herein provided, until (Enter Date). Upon the expiration of the initial term and each renewal term, the term of this Agreement shall automatically be renewed for an additional term of (Enter Number of Years) years unless either party shall have given written notice of non-renewal to the other party not less than (Enter Number of Days) days prior to the expiration of the initial term or any renewal term then in effect, as applicable.

2. If either party defaults in any of its obligations under this Agreement, and such default is not cured within sixty (60) days following delivery of written notice from the non-defaulting party to the defaulting party (i) specifying such breach in reasonable detail, and (ii) expressly stating that such notice is a notice of breach pursuant to this Agreement, the non-defaulting party may terminate this Agreement with thirty (30) days advance written notice to the other party.

1. Compliance with Laws. Indemnification

Each party (in such capacity, an “Indemnifying Party”) agrees to defend and indemnify the other party, its affiliates and their respective officers, directors, employees, and agents (each an “Indemnified Party”) against, and hold the same harmless from, all liability, losses, damages, obligations, judgments, claims, causes of action and expenses (including court costs and attorneys’ fees) (collectively, a “Claim”) resulting from or arising out of, directly or indirectly: (i) the negligence or willful misconduct of the Indemnifying Party; or (ii) any breach by the Indemnifying Party of any of its covenants, representations or warranties contained in this Agreement.

Notwithstanding the foregoing, an Indemnifying Party shall not be obligated to defend, indemnify and hold harmless any Indemnified Party from and against a Claim to the extent that such Claim results from or arises out of the negligence or willful misconduct of any Indemnified Party or any breach by an Indemnified Party of any of its covenants, representations or warranties contained in this Agreement.

Each Indemnified Party shall notify the Indemnifying Party promptly of any Claim asserted by a third party for which such Indemnified Party is or may be entitled to indemnification hereunder, provided that the failure to promptly give such notice shall not affect the Indemnifying Party’s obligation to indemnify and hold harmless the Indemnified Party except to the extent the Indemnifying Party is actually prejudiced by such failure.

The Indemnifying Party shall have the right to assume the defense of any such third party Claim at its own expense, and by counsel reasonably satisfactory to the Indemnified Party, by so notifying the Indemnified Party within (ten(10)) days after the Indemnified Party notifies it of such third party Claim. If the Indemnifying Party so assumes the defense of a third party Claim, it may settle such Claim with the consent of the Indemnified Party, such consent not to be unreasonably withheld, conditioned, or delayed.
