Any noncitizen who intends to work in Malaysia must obtain the correct right-to-work entitlements regardless of the length of their stay. Permanent residents, temporary residents, and work permit holders can legally work in Malaysia. Those who do not have these documents or the correct paperwork, such as those visiting the country on a tourist visa, cannot work in any capacity, even remotely. This means right-to-work checks are essential for any foreign workers.

When employers are ready to hire a foreign worker in Malaysia, they must submit all the documents and information to the Immigration Department of Malaysia on behalf of the employee. The documents required by the employee are determined based on their nationality and the type of visa. It includes:

Application form

Employment contract

Valid passport

Photographs

Confirmation letter from employer

After completing the paperwork and submitting it to the Immigration Department, the foreign employee will get a work visa or employment pass. Only after they receive the pass can they legally start working in Malaysia.

The requirements for a Temporary Employment Pass, or TEP, depend on the employee's nationality and age. There is no specific qualification or experience requirement, but applicants must be between 18 and 45 years of age and from one of the following eligible countries:

Bangladesh (only allowed to work in the plantation sector)

India (not allowed to work in the manufacturing sector)

Indonesia (male workers are not allowed to work in the manufacturing sector)

Philippines (female workers cannot apply for any sector)

Turkmenistan

Professional Visit Pass

People under the following categories are eligible for this one-time entry visa:

Employed by a foreign company

Have a sponsor

Islamic religious teachers

International artists

Government employees

Those from abroad looking to remain in Malaysia for an extended period may apply for the Employment Pass which offers three categories of long-stay work visas for foreign nationals based on the employee’s salary.

An employment pass is a work visa issued to foreign nationals employed or contracted in Malaysia by a company. Individuals acquiring highly skilled jobs, such as engineers, entrepreneurs, and scientists, may also qualify for an employment pass.

The employer needs approval from the Expatriate Committee or a relevant regulatory body to get an employment pass. The employer determines the pass duration, which ranges from one to five years.

This type of visa is for highly skilled foreigners with a basic salary of at least RM 10,000. It is valid for up to five years.

Category II

This type of visa is for skilled foreign employees with a basic salary of above RM 5,000 with a contract of up to two years.

Category III

This type of visa is for foreign workers with a basic monthly salary between RM 2,500 and RM 5,000 and a work contract of one year or less.

To get a work visa for Malaysia, an employee must submit the following documents at the nearest Malaysian Embassy or Consulate:

A completed application form

A passport that has been valid for at least six months

Passport-sized colored photographs

Original employment contract

Confirmation letter from the employer

After approval, employees will receive a visa stamp on their passports. Upon arriving in Malaysia, they must register with the Immigration Department within seven days and obtain a work permit. Once they have the work permit, they can begin working in Malaysia legally.

Work visa sponsorship in Malaysia involves a few steps. Here's the process:

The employer has to apply for foreign work quota approval from the Expatriate Committee to employ foreign workers.

After applying, the employer is interviewed by a representative from the Ministry for the company's particular sector.

After the quota approval, the employer has to submit employment pass applications for each employee to the Immigration Department.

The employer will then need to obtain a letter of approval from the Expatriate Committee.

The employee can then apply for a visa at a Malaysian Embassy or Consulate, depending on their position and field of work.

After submitting the required documents, you can pay the visa fees and wait for approval. Each country has a different visa processing fee, so check with the local consulate.

After visa approval, the employee can legally travel to Malaysia and work in the country.

Malaysia has launched a digital nomad visa, known as DE Rantau Digital Nomad Pass (DNP), to attract digital nomads from around the world. The DNP is a 12-month renewable visa that allows digital nomads to live and work in the country. The applicant can also bring their spouse and children with them under this visa.

The most common requirements include:

A valid passport

Remote employment with an overseas employer

A monthly salary of at least USD 24,000 per year

Employment in the digital sector

When your company starts planning an expansion to Malaysia, hiring talented workers will be essential for a smooth market entry. As you find the right team members, however, you’ll need to ensure that every individual has the proper documentation to legally work in the country, which includes obtaining Malaysia work visas.

Types of work visas in Malaysia

Malaysia has 4 categories of work visas, also known as “work passes”:

  • Employment pass:  An employment pass is the most common visa for international individuals working for a Malaysia-based company in a specialized capacity. Employers have to get approval through the Expatriate Committee or another regulatory agency to hire an employee and obtain this visa. Typically, the employment pass lasts 1 to 5 years, depending on the case or work duration, but it is renewable.
  • Temporary employment pass:  There are 2 categories of temporary employment passes — the Foreign Worker temporary employment pass and the Foreign Domestic Helper (FDH) temporary employment pass. Both are typically issued for up to 2 years.
  • Professional visit pass:  International individuals wanting to work in Malaysia for up to 12 months usually apply for this visa. An international company based outside of Malaysia typically employs these individuals who will temporarily work in Malaysia.
  • Social visit pass:  Short-term visa also known as “PLS@XPATS,” launched in October 2022, allows professionals to work in the country for up to 30 days.

Requirements to obtain Malaysia work visas

The requirements for a Malaysia work pass depend on the type of visa an employee needs. If your company is incorporated in Malaysia, most of your international employees will need to apply for an employment pass. To do so, they’ll need a diploma, a certificate, and relevant work experience. Their monthly salary will need to be at least RM 5,000 a month, depending on the work category.

Other common requirements include:

  • An updated resume
  • Copy of the individual’s passport with a remaining validity of at least 18 months
  • Recent passport photos
  • Copy of employment contract (duly stamped by Inland Revenue Board and signed)
  • Copy of highest educational certificates translated into English
  • Job description
  • A completed application form
  • Other documents specified upon request

Application process

The Immigration Department of Malaysia processes all work visas, but the procedure depends on the type of work pass. For example, you may need to get approval from a state body to bring an international individual into the country; however, different state bodies are responsible for approving different roles across various sectors.

After the above step, the applicant should present all documents to the proper authorities for approval. Once the application is approved, the individual will receive the work pass. Keep in mind that certain fees are attached to all visa types, and they vary based on the job, location, and other related factors. In addition to the main fees, the government also charges administrative costs.

Other important considerations

Individuals with employment pass types I or II can apply for their spouse, parents, and children under the age of 18 to also come to Malaysia. Each person will need a dependent pass, which is issued for either the same or less length than the main employment pass.

How to obtain a work visa Malaysia?

The evolution of business activities in Malaysia is not surprising. Today, the country is one of the main commercial centers of the Asian continent. Malaysia’s economy is based on skills, new technologies and improved infrastructure. All these data attract many expatriates.

To work in Malaysia, you will need a Malaysia work visa in the form of a work permit. There are three types of documents to work in Malaysia (Work Permit, Temporary Work Permit and Professional Business Card). The type of work permit issued by the immigration office depends on the expatriate’s skills. If you want to know more about work permits in Malaysia, this guide is for you.

Working in Malaysia

The Malaysia work visa : a work permit or “Employment Pass”

The work permit allows expatriates to work for a company in Malaysia. This document is issued to expatriates with specific skills in a particular field, usually for technical or managerial positions. First of all, you must find an employer, who will then take care of the administrative procedures to obtain the work visa.

There are three categories for this work permit:

I. First category : “EP1”

These are usually the senior positions. Among the criteria, you have the following:

  • Job seekers receive a monthly salary of RM10,000 or more.
  • The job seekers have an employment contract for a maximum of 5 years. P.S.: Job seekers in this category may bring dependents, such as children or parents, as well as a spouse. Their work permit can be renewed.

II. Second category : the “EP2”

  • These job seekers receive a monthly salary of more than RM5,000 and less than RM10,000.
  • They have an employment contract that is valid for less than 2 years. P.S.: Job seekers in this category may bring dependents. Their work permit can be renewed as well, like the EP1s.

III. Third category : the “EP3”

The monthly salary of EP3 employees is less than RM5000 and equivalent to or more than RM3000. Job seekers have a work contract of one year or less. P.S.: Job seekers in this category are not allowed to bring dependents. Their work permit can be renewed up to two times.

In this category, we can find, for example, the cleaning ladies, the security staff (guards, surveillance agents, etc.).

Regardless of the category, it is the employer who must apply for the work permit. First, the company must apply for an expatriate position with one of the government agencies. The employer must first apply for an expatriate position with one of the government agencies. The employer will need to submit the following documents to the immigration department:

  • The application form for a work permit;
  • A copy of the applicant’s passport;
  • Letter of approval from the immigration office;
  • Employment contract;
  • CV and educational certificates; and
  • Company profile.

Work visa Malaysia: temporary work permit

The temporary work permit is intended for semi-skilled job seekers in specific fields. The temporary work permit is valid for one year. Companies can request an extension on an annual basis for up to 10 years.

In what area of work?

Job seekers must work in construction, agriculture, planting, manufacturing and services and foreign domestic help. The temporary work permit is only available to citizens of certain countries: Bangladesh, Cambodia, India, Indonesia, Kazakhstan, Laos, Myanmar, Nepal, Pakistan, Philippines, Sri Lanka, Thailand, Turkmenistan, Uzbekistan and Vietnam.

P.S.: There are many government restrictions, depending on the country of origin of the job seeker. For example, Bangladeshi citizens are only allowed to work in the plantation sector. Citizens of India are not allowed to work in the manufacturing sector. However, male citizens of Indonesia are only allowed to work in the manufacturing sector. For female citizens of Indonesia, they can work in any field.

How to get it?

As with the first work permit, it is the employer who must file the application. The company will also need to apply for a visa approval letter from the Malaysian Immigration Department. At the same time, the company shall provide the following documents:

  • Application form for VDR (Visa with reference);
  • A letter of approval from the Ministry of the Interior regarding the approval of the quota;
  • Visa application form;
  • Receipt of payment of the levy;
  • Copy of the job seeker’s passport;
  • Passport size photo of the applicant;
  • Medical certificate issued by a medical center in the applicant’s country of origin and valid for a minimum of three months; and Health Insurance;

P.S.: The application for a visa with reference (VDR) is made after the visa approval has been obtained. The application is made to the Malaysian Embassy in the applicant’s country of origin. At the same time, the job seeker must obtain an immigration security clearance from an immigration center in their home country. The job seeker will only receive a temporary work permit after passing the medical examination (FOMEMA) .

Other types of work visas Malaysia : business card

The professional business card is granted to job seekers with the necessary skills to work in Malaysia. It is valid for a maximum of 12 months.

Job seekers must have an employment contract with a company in their home country and provide their services to a Malaysian company through the company in the home country. P.S.: Job seekers are not allowed to bring dependents.

Like other work permits, the application must be made by the Malaysian company. The employer must provide the following documents to the Immigration Department in Malaysia:

  • Letter of offer from the Malaysian company;
  • The company’s profile in Malaysia; and
  • Academic certificates.

Individuals who may apply for the business card must fall into one of the following categories:

  • Islamic missionaries;
  • Government representatives;
  • Volunteers;
  • International students coming to Malaysia on an industrial training or mobility program; and
  • Other religious missionaries.

P.S.: There are several restrictions related to the job seeker’s mission or country of origin. For example, Chinese citizens must add a bank certificate. For religious missionaries, they must add a letter of approval from the Department of Religion. They must also be under forty years old.

P.S.: As with the temporary work permit, the application for a visa with reference (VDR) is made after the visa approval has been obtained. After the employee arrives in Malaysia, it is mandatory to go to the immigration office to receive the business visit sticker on the passport.

Working in Malaysia is a very rewarding experience. The process is very long, but the opportunity is worth the effort.

Malaysia is a great location for foreign workers to live and work. Foreign investors that have the intention to expand their business in Malaysia will find it much easier to send their senior team from their home country to manage the newly Malaysian registered Company via a work visa, such as the Employment Pass.

Malaysia has its own set of regulations and laws when it comes to the employment of foreign nationals. Hence, the Immigration Department of Malaysia has imposed that each employing Company must apply for the right work visa to employ foreign workers. Once the foreign expat attains his Malaysian work visa, only then do the foreign nationals enter Malaysia and start working.

For foreign talents who wish to live and work in Malaysia, they are first required to attain a work visa. The Malaysian Expatriate Talent Service Centre (MYXpats Centre) is the department who are responsible for processing and issuing all Employment Pass (EP) related documents.

A Malaysian registration company may only proceed with an Employment Pass application once it registers and approves by the Expatriate Services Division (ESD).

Malaysia has three types of working visas. The type of visa you select when you apply for Malaysia work visas would depend on your job and the skills involved. The types of visas issued in Malaysia for working professionals are:

Employment Pass visas allow a foreign expat to take up employment with a Malaysian-registered Company. This visa will be subject to the length of the employment contract the employing Company has offered.

The foreigner must hold either managerial or technical positions to be eligible for this visa. Employers will lodge the Employment Pass application on behalf of the foreign expat. EPs are valid for up to 60 months, and approval is issued by the Expatriate Committee (EC).  Other approval agencies include the Ministry of Home Affairs. Holders of this visa can bring their family members with them under the Dependant Pass visa.

On the flipside, the PVP is a work pass visa which allows foreign nationals to take up professional work in Malaysia. The visa is valid for a maximum of 12 months. To qualify for this visa, the foreigner must be residing outside Malaysia at the time of application.

Eligible positions for this type of visa include:

  • Consultants
  • Technical advisors
  • Maintenance installation and fixing experts (machines and equipment)

PVP holders are not entitled to bring their family members with them or apply for the Dependant Pass visa.

All PVP applications must be made outside Malaysia unless the foreigner is applying for an extension. Applications must be submitted by either an employer, sponsor, or school in Malaysia.

If applications are lodged by the school, it should be made at least one month before the learning or teaching commences. Applications must be sent to the Federal Government Administrative Centre (Pusat Pentadbiran Kerajaan Persekutuan). Certain categories of the PVP shall be subject to consideration, and these categories include:

  • Other experts/volunteers
  • Filming and performance by foreign artists
  • Islamic missionary
  • Practitioners/Other religious workers
  • International students who are undergoing religious courses with the Malaysia bible seminary
  • Government to government program or on government purpose

The validity of the PVP will be subject to the requirements and conditions of Malaysia’s immigration rules and policies for a period not exceeding 12 months. Any applications for a PVP, made to undergo training at a factory or hotel, are applicable for a period not exceeding 6 months.

The employing Company must put in the application:

  • Passport copy (preferably certified by notary republic)
  • 12 and IM.38 visa application form (can find from the official website)
  • Letter of offer from a Malaysian registered Company
  • Employing the Company’s latest profile (business plan and Company profile – can be retrieved from the Company Secretary)
  • Academic certificates
  • Letter of approval from the Department of Religion and the Islamic Religious Department (if required)
  • Bank guarantee (for China citizens)

Once approved, the foreign worker can apply for the visa with a reference (VDR) from the Malaysian embassy (if needed). Once arrive in Malaysia, the foreign worker is to visit the Immigration Department of Malaysia to receive the professional visit pass sticker on their passport.

To be an eligible Employment Pass holder, a foreigner must be a degree (or above), diploma or technical certificate holder. They must also have the relevant work experience required for each qualification level.

However, they are subjected to yearly extensions. This would depend on the availability of the specified occupation. TEPs can only be issued after quota approval has been given by the Local Centre of Approval. Family members are not eligible to apply for a Dependant Pass visa.

All quota approval applications must be lodge with the Local Centre of Approval, Ministry of Foreign Affairs. Levies must also pay to the same department. Employers must apply for the Visa with Reference (VDR) and the Visitor’s Pass (TEP). Foreign workers must be outside Malaysia at the time of application. They are only can to enter Malaysia once the application informs about the approvals.

 Foreigners will be allowed to enter Malaysia via these permitted entry points:

  • Kuala Lumpur International Airport (KLIA). Foreign workers must have a working visa from Malaysian Representative Offices overseas.
  • Other entry points are from Thailand and Indonesia. Foreigners from here must obtain a working visa from the Malaysian Representative Office in that country.

Foreigners will also be required to undergo medical examinations at FOMEMA-registered clinics/health centres to obtain a clean bill of health. The Visitor’s Pass (Temporary Employment) sticker can be obtained from the State Immigration Office, or at the Malaysian Immigration Headquarters, Putrajaya.

The Residence Pass-Talent (RP-T) program is a 10-year renewable visa designed for exceptionally skilled expatriates from various fields like Oil, Gas, Energy, ICT, Finance, Education, and Business, aiming to make sustained economic contributions to Malaysia. To be eligible, you need:

  • Three years of work experience in Malaysia.
  • A valid Employment Pass with over 3 months validity.
  • Good tax payment history for the past 2 years.
  • A monthly salary of over RM15,000 (excluding extras).
  • Educational qualifications (degree, diploma, or certificate) and 5 years of work experience in general.

Self-Application

The RP-T holds a significant difference from other types of employment Visas because, unlike other employment passes, the RP-T is not necessary to apply by the employer. Instead, submission must be made by the applicants themselves, and not by any agent. This suits its purpose to cater to professionals seeking to work and live in Malaysia without being bound by the employing company. Hence, this comes with the perk of RP-T pass holders not needing any form of working pass or visa conversion in the case of a change of employer.

Typically, Malaysia Dependent Pass holders can’t work under the conditions of the Dependent Pass. If a family member of an EP holder wants to start working, they must convert their Dependent Pass into an Employment Pass.

However, spouses of RP-T holders can seek employment without applying for Employment Passes of their own.

Children under 18 can also pursue primary and secondary education in Malaysia.

Other Notes

Presently, the Government is only reviewing applications from foreign professionals who have been employed in Malaysia for a continuous period of three years or more at the time of their RP-T application.

Effective from June 2016, there are new work visa Malaysia requirements that all foreigners must be aware of. These changes must be considered when lodging your work permit application. The changes were introduced by the Immigration Department of Malaysia, and they include:

  • Employment Pass and PVP holders must show a copy of the approval letter upon arrival. You will not be able to enter the country while your work visa is still under review.
  • Foreigners must exit Malaysia to renew their work visas. In-country renewals are no longer applicable.
  • For Employment Pass Category I and II holders, the minimum monthly salary of RM5,000 can no longer include allowances. Allowances will not count to meet the minimum salary requirement.
  • All individuals who are looking to work in Malaysia will require a work visa, regardless of nationality.

For PVP holders, there is no stated salary requirement but they should meet the following requirements:

1. Foreign talents with acceptable professional qualifications or skills 2. Employed by an overseas company 3. On behalf of the overseas company, provide services or undergo training with a Malaysian company with supporting documents

Kindly note the following requirements for an Employment Pass application:

Individual requirements: – Have a job offer in Malaysia OR incorporate your own company in Malaysia.

The below are the different categories of an Employment Pass. Kindly note that we only provide services for a category 1 EP. Category I (EPI) – for applicants who earn a fixed monthly salary of at least RM10,000 and a valid employment contract for a minimum of 5 years.

Hi, I have an American co-worker who was supposed to come to Malaysia before COVID-19 hit and MCO was enforced. We’re hoping that he can come sometime in August, but we are unsure if we can apply for him to have the Employment Pass in Category III. He was initially offered a Digital Marketing executive position within our company, but because of COVID-19, we had to suspend the offer until we knew we could apply for an EP visa.

Hello Admin, just wanted to ask, as I am an expat here in Malaysia working under an employment pass visa. What if for example my Employment Pass was not renewed by my employer, so can I apply for social visit pass after the Employment Pass visa expire as I plan to stay either a month just to find or look for work, is that valid reasoning for social pass visa? The requirements for registering a company in Malaysia are simple. They are:

At least one local resident director

Malaysian residents and foreigners can serve as directors of a Malaysian company, provided there is at least one director who is a Malaysian resident.

At least one shareholder

To register a company in Malaysia, you need at least one shareholder who can be a person or another company.

Local company secretary

Employment Pass

An Employment Pass (EP) is a work visa that allows expatriates to work in Malaysia. It is primarily available for senior or technically skilled professionals, managers, executives and technicians (PMETs) with specialist work experience, and on higher salaries.

The EP allows them to live and work legally in Malaysia for up to 60 months. It can then be considered for renewal, subject to approval.

The final decision on approvals for all Employment Pass applications (Category I, II, and III) will be at the discretion of the Immigration Department of Malaysia . But before that, companies will need to submit an approval letter from the relevant agency or regulatory body in their sector, for each employment pass application. Professional visit pass

A professional visit pass (PVP) is a short term working pass which allows expatriates with the relevant qualifications and skills to work in Malaysia on a temporary basis. They are to provide their services in a Malaysian registered company on behalf of an overseas company.

The PVP is valid for up to 12 months — it is non-renewable, and is restricted to one contract or project at a time. It is non-salaried. PVP holders are not entitled to apply for Dependent Passes for their family members.

To qualify for a PVP, applicants must be outside of Malaysia at the time of application.

PVP holders will only be allowed to work with the company stated on the pass. If the PVP holder changes their employer while the pass is still valid, they must cancel their current pass and serve a cooling off period of 3 months before applying for it with a new employer.

Expatriate applicants will need to fall under one of these categories to be granted a PVP:

  • Expertise Transfer
  • Training at ESD-registered companies
  • Exhibitors under regulation of Malaysia Convention & Exhibition Bureau (MyCEB)
  • Foreign embassies;
  • ESD-registered companies; or

Resident pass — Talent

The Resident Pass – Talent (RP-T) offers expatriates the ability to work and live in Malaysia for up to 10 years.

To be considered for the RP-T, applicants have to first fulfil the following criteria:

  • Have worked in Malaysia for a minimum of 3 consecutive years at the time of application;
  • Hold a valid Employment Pass with more than 3 months validity during the submission/resubmission of the application;
  • Earns a basic monthly salary of RM15,000 which excludes any allowances and/or bonuses;
  • Has a Malaysian income tax file number and has paid income tax for the most recent 2 years (minimum) at the time of application;
  • Holds a PhD/Master’s/Bachelor’s Degree or Diploma in any discipline from a recognised university or a professional/competency certificate from a recognised professional institute; and
  • Possesses at least 5 years of total work experience.

With RP-T, expatriates also enjoy the flexibility of being able to change employers without renewing the pass. They are allowed to bring dependents as well. Their spouse and children under 18 years old are eligible for the RP-T dependent pass , while their dependents over 18 years old, parents and parents-in-law are eligible for a renewable one-year Social Visit Pass for up to five years.

An RP-T holder’s spouse can seek employment without having to apply for an Employment Pass. Their children under 18 years old are also eligible to pursue primary or secondary education in Malaysia — higher or tertiary education is not included.

Malaysia Tech Entrepreneur Programme

The Malaysia Tech Entrepreneur Programme (MTEP) is a specially designed pass to attract foreign tech entrepreneurs from all around the world and help them set up and develop their business in Malaysia. Targeted sectors include agritech, dronetech, fintech, healthtech, cybersecurity, blockchain, artificial intelligence, big data analytics and more.

There are 2 different tiers of passes under the MTEP:

  • Professional Visit Pass (PVP-MTE) for new entrepreneurs with a 1-year validity; and
  • Resident Pass (RP-MTE) for established entrepreneurs and investors with a 5-year validity.

Only resident pass holders are able to bring dependents. Spouses are eligible to work in Malaysia and must hold a professional designation under the approved National Key Economic Areas (NKEA) as outlined in the Economic Transformation Programme (ETP).

There are two types of temporary employment passes issued:

  • To foreign workers in the manufacturing, construction, plantation, agriculture and services sectors; and
  • To foreign domestic employees.

Foreign workers:

To qualify for the TEP, foreign workers have to:

  • Be between 18 and 45 years of age;
  • Undergo a medical examination by an approved medical centre and cleared as healthy and fit to work;
  • Undergo immigration security clearance (ISC) verification in an ISC Centre in their home country; and
  • Come from one of the following countries.

The list of approved countries are:

  • India (not allowed to work in the manufacturing sector)
  • Indonesia (male workers are not allowed to work in the manufacturing sector)
  • Philippines (female workers are not allowed to apply for any sector)
  • Turkmenistan

Foreign workers with a TEP are not allowed to bring dependents. They cannot change jobs or change employers without obtaining permission from the Ministry of Home Affairs. They also cannot marry a local resident or a migrant worker.

They are allowed to work for up to 12 months, and must leave the country when the pass expires, is revoked, or if their employment contract is terminated. The pass is renewable, subject to the approval of the relevant authorities.

Employers are required to obtain a foreign worker quota approval from the Local Centre of Approval, Ministry of Home Affairs before submitting the application. Foreign domestic helpers, cooks who are citizens of Thailand, and rubber tappers in the northern states and east coast do not require such approval.

Foreign domestic employees:

To qualify for the TEP, a foreign employee should:

  • Be between 21 and 45 years old;
  • Certified to be fit and healthy to work by an appointed medical centre;
  • Reside in the country of origin;
  • Enter Malaysia via the Visa With Reference (VDR) issued by the Malaysian representative office in the country of origin.

In addition, she must come from one of the following approved countries:

How to Apply for a Work Visa in Malaysia

Malaysia is one of those countries in Asia that are close to the Filipinos’ hearts – for historical, practical, and geographical reasons.

In the past, many Filipinos, especially those coming from Mindanao migrate to the Malaysian state of Sabah to escape the war in the region,  find work , and start a better life.

To this day, Malaysia still is one of the top destinations in Asia where many Filipinos go for work. If you’re interested in coming over here in Malaysia, you first need to know the basic requirements for applying for a  work permit .

Like in many countries, a work permit is essential before you can start working here in Malaysia. However, there are several ways for you to obtain a work permit:

The first approach is the more convenient one for the migrant worker or foreign employee entering Malaysia to work. The company or the employer will file the application for their foreign employee’s work permit to allow them to travel to Malaysia for work.

Otherwise, those who are looking for work may travel to Malaysia first on social passes and then, later on, apply for a work permit afterward.

Important :  Malaysia imposes stringent laws for illegal workers, so it is highly recommended not to start working before the working permit is issued.

Also, if you’re coming with your family for work, your dependents will also have to apply for their own working permits if they wish to work in Malaysia.

To start your application for a work permit, you need to prepare the following documents:

  • Copy of applicant’s passport;
  • One passport photo;
  • A letter of a work permit application from your employer;
  • Visa application;
  • Letter of approval from the Ministry of Home Affairs;
  • Original receipt of fees paid;
  • Visa with the Reference application form;
  • Medical report from the country of origin approved by the Ministry of Health Malaysia.

When preparing your documents, make sure that your passport has a remaining validity of at least 18 months; you must be at least 27 years of age (except for those applying to work in the IT sector, where the required minimum age is 23). Malaysian work permits are typically issued for periods between 6 months and 5 years.

Employers who wish to process the application for visa and work permit can be viewed on the official website of the  Malaysian Immigration Department .

The type of work pass you get is mainly based on the type of job and skills you possess when you come here to Malaysia.

  • Category I  – The applicant must receive a monthly base salary of  above   MYR 5,000  and have an employment contract with a minimum validity period of 24 months. Applicants may bring eligible dependent(s) and/or foreign domestic helper(s), subject to approval and the employment pass may be renewed.
  • Category II  – The applicant must receive a monthly base salary of  above MYR 5,000  and have an employment contract with a maximum validity period of 23 months. The employment pass may be renewed.
  • Category III  – As of July 2015, Malaysia has introduced this employment category which is available to foreign nationals working on contracts of 12 months or less and with monthly salaries ranging from  MYR 2,500 to 4,999.  This type of employment pass may be renewed up to two times. Under this category, applicants are not allowed to bring dependent(s) and/or foreign domestic helper(s).

Important Notes:

– It is mandatory for successful applicants to obtain a Visa with Reference prior to entry into Malaysia;

– Employers who wish to employ expatriates under employment pass (Category III) are required to obtain an exemption from the Ministry of Home Affairs (MOHA) prior to submission of the employment pass (Category III) application. MOHA approval is granted on an annual basis.

  • Temporary Employment Pass:  Issued for employment for  less than 2 years  or for jobs with a monthly salary  less than RM 5000.
  • Professional Visit Pass:  Issued to foreign nationals who remain employed by the company in the home country but are required by a Malaysian company to provide certain services for a period of  up to 6 months .

What is the Process for Applying for a Malaysian Work Visas?

As mentioned earlier, your employer has to apply for a Malaysia work permit on your behalf. They must submit an application with the Immigration Department of Malaysia. Once the Immigration Department approves the application, you may travel to Malaysia or apply for a visa with reference if you are a visa-required national.

Here is the application process for a foreign employee’s work permit:

The employer has to apply for an Expatriate Post from the Expatriate Committee (EC) or another relevant authority agency before they apply for your  Employment Pass .

There are several agencies appointed by the Malaysian government for the approval of Expatriate Posts:

  • Malaysian Industrial Development Authority (MIDA) for the sectors of manufacturing and services.
  • Multimedia Development Corporation (MDeC) for the technology sector.
  • Central Bank of Malaysia (BNM) for the sectors of finance, insurance, and banking.
  • Malaysian Biotechnology Corporation (BiotechCorp – BC) for the sector of biotechnology.
  • Securities Commission (SC) for the sector of securities and futures market.
  • Expatriate Committee (EC) for sectors other than the ones mentioned above.

If your employer will hire you using a  Temporary Employment Pass,  he/she has to apply for quota approval at the Local Centre of Approval from the Ministry of Foreign Affairs.

Once your application for a work permit has been submitted by your employer to the Immigration Department of Malaysia, and once it is approved, you will receive a  visa approval letter , which allows you to travel to Malaysia.

Visa-required nationals need to apply for a Malaysia Visa with Reference from a Malaysian Embassy or Consulate to be allowed entry to the country.

A Malaysian Visa With Reference means that the applicant had to get the visa approved by the Malaysia Immigration Department before they could apply at an Embassy/Consulate.

On the other hand, Visas Without Reference are  tourist visas , which are issued by the Embassy/Consulate without needing approval from the Immigration Department.

Once you arrive here in Malaysia, you need to submit your passport and pay for the Pass at the Malaysian Immigration Department. They will process your application and issue you with a sticker on your passport and a work permit card. Only then will be allowed to legally work in the country.

Although foreign workers can try either of the two ways to get a work permit here in Malaysia, it is best to find an employer first and have them process your documents so you won’t encounter any complications when you get here.

In recent years, Malaysia has become very strict when it comes to dealing with illegal foreign workers staying in the country. So, keep in mind that when looking for a job (which you can now do online), it is best to look for an employer first who will help you get a visa to work in Malaysia.

Malaysia is a multi-ethnic and multi-religious country in Southeast Asia. The nation is known for its capital city of Kuala Lumpur, a financial powerhouse and business hub in Southeast Asia. 

The nation showcases a rich culture with a mix of Malay, Chinese, Indian and European influences.

Malaysia is relatively peaceful and has a stable economy with a good infrastructure such as a world-class airport, an extensive road network and sound financial institutions. The country has successfully diversified its economy from agriculture and commodity-based to solid manufacturing and service sectors. 

Although English is not the main language, it is widely spoken especially in urban and city centres. This would greatly help foreign nationals settle in their new environment. The latest data shows that the country hosts around 2.1 million documented foreign workers.

International students graduating from a Malaysian higher institution can only stay and live in the country if they can find an employer willing to sponsor their work permit so they can legally work in the country. This means that the student visa will not be automatically extended and foreign students will need to leave Malaysia after graduation unless they land a job offer.

To protect the local workforce, there are policies in place that mandate Malaysian citizens be given first priority in job vacancies. However, all hope is not lost as certain jobs and sectors are open for international graduates especially in international companies.

Work Permits

As a foreign student, you will also have to make sure your passport is valid for at least 18 months in order to be eligible for a work visa. Your Malaysian work permit will vary depending on the role, salary, and job contract.

The three types of Malaysian work permits are:

Employment Pass (EP)

  • Visitor’s Pass (Temporary Employment Pass)

Professional Visit Pass 

Read on to see which one you might be able to qualify for.

This is the most common pass for those who have been offered an extended job contract of over 2 years with a Malaysian company, with a monthly salary of RM 5,000. Depending on the category, you may be able to bring your immediate family with you.

The Employment Pass is typically offered for skilled workers, professionals and those in management roles. The Expatriate Committee (EC) will have to confirm that a foreign national from another country can take the role over someone from Malaysia. 

To be eligible for the permit, you need to meet the following conditions:

  • Degree and above, with at least 3 years experience in the relevant field
  • Diploma, with at least 5 years experience in the relevant field
  • Technical Certificate or equivalent, with at least 7 years experience in the relevant field

The application must be done by your employer. 

There are three types of Employment Pass depending on your monthly salary. See the chart below.

To apply, aside from the requirement to be submitted by your employer, you also need to prepare the following documents.

  • Recent passport photo 
  • Copy of passport (full booklet with cover) 
  • Copy of highest educational certificates
  • Latest comprehensive Resume 
  • Copy of Employment Contract (duly stamped by Malaysia Inland Revenue Board) 
  • Supporting document from Approving Agency/Regulatory Body (if applicable) 
  • Detailed Job Description printed on company’s letterhead 
  • Tax payment receipts (if any)

*Additional documents may be requested

Once all required documents have been submitted, all applications will be processed within 5 working days.

Foreign nationals may only work for the company named in the Employment Pass. If you change companies, you need to resubmit an application. The pass is subject to the contract of employment for up to 60 months or 5 years and can be renewed.

There are a few things you need to know when renewing your permit.

  • Employment Pass Category III holders whose pass had been renewed 2 times or 3 years in a row must leave the country and serve 3 months cooling-off period to be able to apply for Employment Pass Category III again. An exemption is only given for cases of Employment Pass Category II converting to Employment Pass Category I/II.
  • Employment Pass Category III holders who are changing employers MUST leave the country and serve 3 months cooling-off period to be able to apply for Employment Pass Category III with different employers.

Visitor's Pass (Temporary Employment Pass)

This is normally available to those with a job where the contract is for less than 2 years or where the monthly salary is less than RM 5,000. This option is available for up to 5 years maximum and for those aged 18-45.

Approved Sectors:

  • Manufacturing
  • Agriculture
  • Construction

Your employer must submit the application but you have to prepare the following documents:

  • Copy of valid passport
  • Recent photo
  • Medical report from the country of origin approved by the Ministry of Health Malaysia

The Professional Visit Pass is available to foreign nationals who have professional qualifications and skills who are either working for a foreign company or will only be in Malaysia for 12 months or less. 

This Pass would be for those working in a specific field, including the following: 

  • Technical Advisor
  • Maintenance Expert
  • External Auditor

The application has to be submitted by your employer. You should also prepare the following documents:

  • Copy of highest education certificates
  • Latest comprehensive resume

Permanent Residence Pass

To obtain permanent residency, foreign nationals will usually need to live continuously for a minimum of 5 years in the country under a legal form of documentation. 

Just living in the country for a designated amount of time doesn’t always qualify you for permanent residency. Similarly, there are certain methods under which to gain permanent residency in even less time.

The Malaysian government lists the following categories under which permanent residency can be granted:

High net worth individuals

Must open a bank account in the country and deposit a minimum of 2 million USD, maintaining it for 5 years. This grants you permanent residency immediately, gives your children and spouse a long-stay visa, and grants them permanent residency as well after 5 years.

Experts/Professionals

This is offered to highly skilled and experienced Employment Pass holders. You must have lived in the country for a minimum of 5 years. You will need government approval, citizen/PR holder sponsorship, and employer references.

Spouses of Malaysian citizens

You will need to be married to a Malaysian citizen for 5 years before applying, have a sponsor, and have had a valid long-stay visa for 5 years.

Those who score high enough in the point-based system

Malaysia offers a point-based system for permanent residency, in which applicants must score at least a 65 out of a possible 120 and also have a sponsor. Categories for obtaining points include salary, age, work experience, language proficiency, investment, time living in Malaysia.

To apply, you will need the following documents:

  • Completed Permanent Residence form 
  • Passport that covers the previous 5 years of living in Malaysia
  • Passport photo
  • Sponsorship from a Malaysian citizen or permanent residence holder

Naturalised Citizenship

Foreign nationals with no Malaysian origins can obtain Malaysian citizenship by naturalisation. The only requirements are that you are over the age of 21 years, have resided in Malaysia for more than 10 years in the 12 years period immediately preceding the date of application, and can show adequate knowledge of the Malay language.

You need to submit your application at the National Registration Office with the following documents

  • Application form C
  • Identity card
  • Birth certificate
  • Entry permit
  • Identity cards of 2 Malaysian sponsors
  • Proof of Malay language proficiency
  • Other documents from spouse or children (if applicable)

Gentle Reminder : Do not expect that an application for citizenship does actually imply that it will be automatically granted. It may take a while to get any response.

Apart from all the beautiful views, food and low cost of living, the job opportunities in Malaysia are staggering. The Malaysia work visa has made it all the easier to move to the country as an expatriate. 

The Malaysian work visa is an endorsement that lets individuals enter the country to take part in employment opportunities for a long duration. Only a few nationals have visa-free entry for this purpose. A Malaysia work visa for Indians is a mandatory requirement if you are an Indian passport holder. Something to note is that being a type of the ‘Visa with Reference’ (VDR), your dependee or sponsor will have to procure a letter of approval from the Immigration Department in Malaysia first. There are 3 categories under which these are issued, namely - 

  • Employment pass - This is granted if you are travelling to work in a highly-skilled position such as technical or managerial jobs. These can be issued for a duration up to 5 years depending upon the duration of the work.
  • Social visit pass (temporary employment) - This is granted for a duration of up to 2 years and issued for people working in specific sectors such as manufacturing, construction, domestic help, agriculture, etc. 
  • Professional visit - This is issued for people who are visiting Malaysia for a temporary work of fewer than 12 months. In this case, the employer is not a Malaysian company. 

Malaysia Work Visa

Applications for the Malaysia work visa for Indian citizens have to be made through a Visa Application Centre (VAC). However, before starting the application, you must ensure that you are eligible to apply for the work category, You can then proceed to make the application as follows - 

  • Visit the website of the Malaysian Visa Application Centre (VAC).
  • Download the application form and fill in all the details. 
  • Proceed to book an appointment at the VAC for the application submission. 
  • Visit the appointment centre with the application form, documents, and the fees. 
  • Submit your application at the VAC.

Ensure that you provide true information and genuine documents. Providing false information and fake documents can lead to visa rejection. In case you are facing difficulties in the process or if you are confused about the requirements, you may use the services of a travel agency.

To apply for the Malaysia work visa from India , you must meet the following eligibility criteria - 

  • You must be living in India while lodging the application. If you are living on a residence permit in another nation, you will have to apply to the respective authority there.
  • You must hold a passport valid for at least 6 months from the date of your entry in the country. 
  • You must possess an approval from the Immigration Department in Malaysia. The request for approval will be made by your employer.
  • Employment pass - Your monthly salary must be a minimum of RM3000, and at least RM10,000 in certain specific cases. (RM- Malaysian Ringgit)
  • Social visit pass - You must be between the ages of 18 and 45 and must be from one of the approved countries. 
  • Professional visit - You must be employed by a non-Malaysian organization. In this case, your sponsor in Malaysia will have to apply for approval.

As per the Malaysia work visa requirements from India , the following documents are necessary for the application - 

  • Fully filled and signed application form.
  • 2 photos as per the specifications. 
  • Educational documents such as degree copy, transcripts, etc. 
  • Employment contract.
  • If you are applying at a VAC outside your jurisdiction, you must also provide Aadhar card, rent agreements, Marriage certificates, etc. 
  • Approval letter from the Immigration Department in Malaysia.
  • Confirmed flight tickets. 

As per the Malaysia work visa photo requirements , the photographs submitted must meet the following specifications -

  • 35mm X 50mm
  • Colour: Coloured
  • Head must occupy the central position
  • Must be captured within the last 3 months
  • Background: Solid, plain white or grey
  • 80% face coverage
  • Neutral expression
  • Glasses: Thin framed and prescription glasses only
  • Headgears - only for religious reasons
  • Facial hair - permitted

The time for processing of the work visa depends on the volume of applications at the embassy, the number of entries, your previous travel history, staff availability at the VAC, and so on. Normally, it can take up to 7 days to process the application. It can also take quite a lot of time getting the letter of approval. As a result, ensure that you apply well in advance. 

The fees for the work permit depends on the foreign exchange rates as well as the country of application. It also includes other service charges levied by the VAC, as well any delivery charges if you choose that option. You must check the exact amount before starting the application.

After submitting your work visa application at the respective VAC, it is then forwarded to the High Commission of Malaysia in New Delhi or to the Consulate General of Malaysia in Mumbai or Chennai as per the jurisdiction. The respective mission will then process your application. Note that the VAC or the embassy has no influence over the decision making of the visa. These visas are approved by the Immigration Department in Malaysia. The embassy/consulate simply process your entry visa.  

Once your application has been successful, you can collect your passport from the VAC, or have them deliver it to you for an additional charge.

On successfully obtaining your work pass approved, you must keep in mind the following few points to ensure that you have a hassle-free journey -

Before you travel - 

  • Note the validity and stay duration mentioned on your visa. You must not stay in the country beyond this period.
  • Carry all your travel documents before you travel to the country. 

At the border

  • You must show your passport with the visa to the immigration officer. Your entry stamp will be stamped on the passport.
  • You may be asked to show the copy of the other documents submitted as part of your application. 
  • You may be asked about the basic details of your visit including details on the nature of your work. Ensure that you answer honestly and without any hesitance. 

When you enter Malaysia

  • On entering Malaysia, take your passport to the Immigration Department or to the respective employer to get the work permit sticker stamped.
  • Carry a copy of your passport and visa while you are travelling within the country.
  • You must respect the culture and customs of the country, as well as abide by the immigration laws during your stay. 
  • Follow the laws in the country. Drug trafficking and use in Malaysia is a death penalty offence. 
  • You may be subjected to pay taxes in Malaysia. 
  • You may be able to bring your family on respective dependent visas.

Unlike the short duration permits, the work pass may be extended as per your contract. You can do this by visiting the immigration department in Malaysia and applying for an extension. Once your work permit has expired, you are not allowed to stay back. There is no stay back period allowed for the work pass. Staying back in the country after expiry is considered as an offence and can lead to fines and even deportation in certain cases.

As per the work permit requirements, there is no need for a medical test from India. However, certain other nationalities may have to submit a yellow fever vaccination certificate. Either way, it is suggested that you get a medical test done before travelling to a foreign country.
